Syncky Health — Terms of Use

Last updated: 25 October 2026

The app is licensed to you under Apple's Licensed Application End User License Agreement (the Standard EULA, https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These terms add the rules for our service: the plans, Relay, updates and what each side is responsible for. If the two disagree about the app licence, the Standard EULA wins. Nothing in these terms limits the rights you have as a consumer under the law of the country where you live.

1. What Syncky is

Syncky Health ("the app") is an iPhone app by Smirnovs Sergejs ("we"; full details at https://syncky.app/impressum). It sends Apple Health data to places you choose: your servers, an AI agent you run, or a file. It also writes entries from those sources back into Health. Relay is our optional message service between your iPhone and your agent. The app moves data. It is not a medical device, does not interpret your data and gives no medical advice.

What you need. An iPhone with iOS 18 or later and the Health app. For an agent: a computer or server of your own that can run the Syncky agent (Node.js 22) and reach the internet. For a server connection: a server that accepts HTTP or HTTPS requests; for a plain HTTP address outside your local network or your Tailscale network, the app warns you that health data travels unencrypted, and HTTPS is recommended. The app does not run on Android, iPad as a separate product, or the web.

2. Your responsibilities

3. Plans, subscriptions and the tip

4. Relay service

Relay is a mailbox: it stores sealed messages and hands them to the other side. Messages are kept for at most 7 days. A message not collected by then is deleted, and the app has to send it again. We run Relay with reasonable care but without a guaranteed uptime; iOS also decides when the app may run in the background, so delivery times vary. To keep the service available for everyone, we may adjust technical limits such as message size, request rate and storage per hub for valid reasons (abuse, stability, running cost), within what the use described in these terms needs; a change that would affect your access or your use more than slightly follows section 5. We may delete hubs that are abandoned, unpaid beyond the periods in the Privacy Policy, or used in breach of these terms. If we discontinue Relay, we give at least 30 days' notice in the app's release notes and on https://syncky.app; your statutory rights for a period you have already paid remain.

5. Updates and changes to the app

We provide the updates that are needed to keep the app and Relay as described in these terms, for as long as your subscription runs, and for one-time purchases for the period you can reasonably expect given the nature of the purchase (§ 7 Verbrauchergewährleistungsgesetz). Updates come through the App Store; you need to install them, and a notice in the app tells you when an update is required for Relay. We may change the app and Relay beyond that for valid reasons such as security, changes in iOS or HealthKit, legal requirements or the cost of running Relay, at no extra cost to you, and we tell you clearly what changes. If a change affects your access to the service or your use of it more than slightly, we inform you in advance, in a form you can keep (a notice in the app that you can save, and the page at https://syncky.app/terms), about what changes and when, and about your right to end the plan or, where we can offer it, to keep the unchanged service. You may then end the affected plan free of charge within 30 days after the change, or within 30 days after you received the information if it reached you later (§ 27 Verbrauchergewährleistungsgesetz); Apple refunds the unused period.

6. Open-source components

The Syncky protocol, the reference agent and the reference server are published under the Apache License 2.0 at https://github.com/syncky/syncky-open. The app and Relay are not open source. The open-source components the app and Relay contain are listed at https://syncky.app/licenses.

7. Privacy

Our Privacy Policy at https://syncky.app/privacy describes what the app, Relay and the optional usage statistics process.

8. No medical use

Syncky Health is intended to transfer, store and format health data on your instruction. It does not provide medical, diagnostic or therapeutic services and is not a medical device. Do not make health decisions from data that Syncky moves or shows without talking to a professional. Data may be delayed, incomplete, or changed by sources you connect.

9. Warranty and liability

Your statutory warranty rights as a consumer (Verbrauchergewährleistungsgesetz) apply to the app and to Relay and cannot be limited by these terms.

We are liable without limit for damage caused intentionally or by gross negligence, and for injury to life, body or health. For damage caused by slight negligence we are liable only where we breached an obligation that these terms exist to fulfil, and then only for the typical, foreseeable damage. To that extent we are not liable for:

These limits do not apply where the law does not allow them, and they do not limit your rights as a consumer in the EU or the UK.

10. Termination

You may stop using the app at any time. Delete Relay data, in Settings › Relay & new iPhone, removes your iPhone from Relay. We may suspend Relay access for hubs that breach section 2 or 4, and we will tell you why if you ask.

11. Changes to these terms, law and disputes

We may change these terms only for valid reasons (a new legal requirement, a change in Apple's requirements, a new or changed feature, security), and only in the parts that reason requires. We post the change with its date at https://syncky.app/terms and tell you in the app at least 30 days before it applies. A change never reduces what you are entitled to for a period you have already paid, and it does not apply to a lifetime purchase unless it only adds to your rights or the law requires it. For a subscription, the changed terms apply from your first renewal after those 30 days; the notice points this out, and if you do not want the changed terms, cancel the renewal in your App Store settings before they apply. If the notice reaches your app later than 30 days before the change, the 30 days count from the day your app received it. Changes that only benefit you or that the law requires may apply at once.

These terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection of the country where you live still applies, and you may sue and be sued only where the law of that country allows.

Dispute resolution: we are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (§ 19 Alternative-Streitbeilegung-Gesetz). You can still write to support@syncky.app, and we answer every complaint within 14 days. If we cannot settle your complaint, our answer names the board that would be competent, Verbraucherschlichtung Austria (verbraucherschlichtung.at), and repeats that we do not take part (§ 19 Abs. 3 AStG); your right to go to court is unaffected.
